Terms of Service
Version dated 13 September 2026.
1. General
1.1. These Terms of Service (the "Terms") govern the relationship between 3 Krolika LLP (BIN 251240001464, address: 010000, Republic of Kazakhstan, Astana, Taras Shevchenko Street 4/1, unit 17; participant of the Astana Hub international technopark; "we", "us") and any person using the gardmi service (the "User", "you").
1.2. The gardmi service (the "Service") means the website gardmi.com, its subdomains, the web application for planning a plot, house and utilities (2D, 3D, VR), the AI assistant, the catalogs of objects, plants, materials and protection zones, reference articles, the API and all related features.
1.3. By using the Service in any way (opening the editor, creating a project, signing in by email, viewing a project by link) you confirm that you have read, understood and accept these Terms and the Privacy Policy in full. If you disagree with any provision, stop using the Service.
1.4. These Terms constitute a public offer; using the Service constitutes acceptance.
2. Definitions
- Project — a plan created by the User in the Service (plot, house, floors, utilities, objects, notes, version history) and its exports (PNG, PDF, JSON and other formats).
- User Content — Projects and everything the User uploads to or enters into the Service: underlays (scans, topographic surveys, photos, images), DXF/SVG/PDF/JSON/.plan files, 3D models, prompts to the AI assistant, notes, addresses, coordinates and cadastral numbers.
- Account — the user record created when signing in with a one-time email code.
- Anonymous access — use of the Service without an Account; ownership of a Project is determined by a technical identifier in a browser cookie.
- Reference Data — setback norms, protection zones, object dimensions, plant and material characteristics, prices, maps and cadastral information displayed by the Service.
3. Age and capacity
3.1. The Service is intended for persons aged 18 or older with full legal capacity. By using the Service you confirm that you meet this requirement. If the law of your country sets a different age for entering into such an agreement, that age applies.
3.2. If you use the Service on behalf of an organisation, you confirm that you are authorised to accept these Terms on its behalf.
4. Description of the Service and disclaimer of warranties
4.1. The Service is a tool for preliminary (sketch) planning. It helps place objects, estimate distances, areas and volumes, view a plan in 3D and prepare a diagram for discussion.
4.2. The Service is not a design, surveying, engineering, cadastral, valuation or legal service. Outputs of the Service (plans, diagrams, estimates, exports) are not design documentation, construction drawings, a boundary survey, a technical opinion or any other document of legal significance, and may not be relied upon for construction, permits, transactions or disputes without verification and formalisation by licensed professionals and competent authorities.
4.3. Reference Data (norms, protection zones, distances, dimensions, prices, plant and material characteristics) are compiled from public sources, may contain errors, become outdated, and may not reflect local zoning, regional or sector-specific rules or the specifics of a particular plot. The User must independently verify applicable rules against current primary sources and with competent authorities before making any decision.
4.4. Map, satellite and cadastral data are provided by third-party providers (including Esri, Google, Yandex and public state registries) and may be inaccurate in position, scale or currency. Locating a plot by address or cadastral number is approximate and does not replace a geodetic survey or official registry extracts.
4.5. Cost estimates, material quantities, drainage, irrigation, electrical, pool and other calculations are indicative, based on simplified models and typical assumptions. They do not replace a designer's calculation and are not a commercial offer.
4.6. The AI assistant uses large language models of third-party providers. Its answers and actions may be inaccurate, incomplete or wrong and may misinterpret norms and geometry. The User must verify the assistant's output. The assistant does not provide legal, engineering or other professional advice.
4.7. The Service is provided "as is" and "as available". We do not warrant uninterrupted or error-free operation, preservation of Projects, compatibility of imported or exported files with other software, or fitness for a particular purpose.
4.8. We may at any time change, supplement, limit or discontinue any feature of the Service, catalogs or Reference Data without prior notice.
5. Account and anonymous access
5.1. Sign-in uses an email address and a one-time code. No password is used. You are responsible for access to your mailbox and for all actions taken in your Account.
5.2. With anonymous access, a Project is tied to a technical identifier in a browser cookie. Clearing cookies, changing browser or device, or using private browsing results in loss of access to anonymous Projects; it cannot be restored. Sign in by email to keep your Projects.
5.3. A Project link (project address, "share" link, public access) is a secret: anyone who has it can view or, in the relevant mode, edit the Project. You control distribution of links and bear the related risks.
5.4. We may delete Accounts and Projects inactive for more than 12 months, and anonymous Projects inactive for more than 6 months, notifying by email where an Account exists.
5.5. You may delete your Account in the settings; Projects and related data are then deleted as described in the Privacy Policy.
6. Rights to content
6.1. All rights to User Content remain with the User (or the respective rights holder). We claim no rights to your Projects.
6.2. To operate the Service you grant us a non-exclusive, royalty-free, worldwide licence to store, reproduce, process, convert, display and transmit User Content solely to the extent necessary to provide the Service (including autosave, versions, previews, export, display via share links, processing by the AI assistant and storage with our technical contractors).
6.3. By uploading content you warrant that you hold all necessary rights to it and that its use in the Service does not infringe third-party rights (copyright, related rights, image rights, personal data, trade secrets, etc.).
6.4. The exclusive rights to the Service, its code, design, databases, catalogs, icons, texts and the gardmi trademark belong to us. The User receives a limited, revocable, non-exclusive licence to use the Service for its intended purpose. Copying, decompiling, scraping and bulk extraction of catalogs and Reference Data, creating derivative services and circumventing technical limits are prohibited.
6.5. You may use plans exported from the Service (PNG, PDF, etc.) for any lawful purpose, including commercial, subject to clause 4.2.
7. Prohibited conduct
7.1. It is prohibited to:
- upload content that infringes third-party rights, contains malicious code, or contains third-party personal data without a lawful basis;
- use the Service to violate the law, prepare unlawful acts or interfere with others' property;
- disrupt the Service: automated requests, overloading, circumventing limits, guessing links to others' Projects, unauthorised access attempts;
- use the AI assistant to generate unlawful content or to extract system instructions;
- present Service outputs as official design or cadastral documentation.
7.2. We may, without notice, restrict access, remove content and block an Account in case of breach of these Terms or at the request of competent authorities.
8. User responsibility and indemnification
8.1. The User is solely and fully responsible for all decisions made on the basis of the Service, including placement of objects, construction, planting, utility routing, purchases, transactions, filings with authorities and compliance with norms, rules and permitting procedures.
8.2. The User shall indemnify us, our affiliates and contractors against any losses, costs (including reasonable legal fees) and third-party claims arising from the User's breach of these Terms, the law or third-party rights, or from the use of User Content.
9. Limitation of liability
9.1. To the maximum extent permitted by applicable law, we are not liable for any direct, indirect, incidental, consequential or punitive damages, lost profits, loss of data or Projects, construction or rework costs, fines, orders, or disputes with neighbours or authorities arising from the use of or inability to use the Service, the Reference Data, the AI assistant, maps or cadastral information.
9.2. Our aggregate liability for any claims is limited to the amount actually paid by the User for the Service in the 12 months preceding the claim, or, for free use, to an amount equivalent to KZT 10,000 (ten thousand tenge).
9.3. Some jurisdictions do not allow certain limitations of liability; in such cases the limitations apply to the maximum extent permitted.
10. Fees and paid features
10.1. As of this version, the core features of the Service are free of charge. We may introduce limits, paid features and plans; their terms, payment and refund procedures will be published separately before any charges apply. Free provision of the Service creates no obligation to provide it free of charge in the future.
11. Third-party services
11.1. The Service relies on third-party services: map providers (Esri, Google Maps, Yandex Maps), state cadastral registries, AI model providers, cloud storage, web analytics, error monitoring and email delivery. Their use may be subject to the providers' own terms; we are not responsible for their availability, accuracy or actions.
12. Rights-holder notices
12.1. If you believe content in the Service infringes your rights, send a notice to support@gardmi.com describing the protected work, a link to the disputed content, your contact details and proof of authority. We will review the notice and, if the infringement is confirmed, restrict access to the content.
13. Changes to the Terms
13.1. We may amend these Terms. A new version takes effect upon publication on this page unless stated otherwise. Continued use of the Service constitutes acceptance of the new version. We endeavour to announce material changes on the website or by email.
14. Governing law and disputes
14.1. These Terms are governed by the laws of the Republic of Kazakhstan, unless mandatory consumer-protection rules of the User's country require otherwise.
14.2. Pre-trial claim procedure is mandatory: send a claim to support@gardmi.com; the response period is 30 calendar days. If no agreement is reached, the dispute shall be referred to the competent court at our location (Astana, Republic of Kazakhstan), unless applicable consumer-protection law provides for a different venue.
14.3. To the extent permitted by law, disputes are resolved on an individual basis; class actions are waived.
15. Users in the EEA, UK and USA
15.1. For users in the European Economic Area and the United Kingdom nothing in these Terms limits rights granted by mandatory consumer-protection and data-protection rules (GDPR / UK GDPR). For California users, applicable CCPA provisions are described in the Privacy Policy.
16. Miscellaneous
16.1. Invalidity of any provision does not invalidate the Terms as a whole. 16.2. These Terms together with the Privacy Policy constitute the entire agreement of the parties. 16.3. We may assign our rights and obligations to an affiliate or successor with notice on the website. 16.4. Neither party is liable for non-performance caused by force majeure.
