Terms of Service
Version dated 27 October 2026.
1. General
1.1. These Terms of Service (the "Terms") govern the relationship between individual entrepreneur Ivan Vyacheslavovich Vaskov (INN 661103103710; "we", "us") and any person using the gardmi service (the "User", "you").
1.2. The gardmi service (the "Service") means the website gardmi.com, its subdomains, the web application for planning a plot, house and utilities (2D, 3D, VR), the AI assistant, the catalogs of objects, plants, materials and protection zones, reference articles, the API and all related features.
1.3. By using the Service in any way (opening the editor, creating a project, signing in by email, viewing a project by link) you confirm that you have read, understood and accept these Terms and have read the Privacy Policy. If you disagree with any provision, stop using the Service.
1.4. These Terms constitute a public offer; using the Service constitutes acceptance, and for paid services (section 10) — paying for Pro access or an energy pack.
1.5. We provide the Service and its paid features. Paid services are governed by section 10.
2. Definitions
- Project — a plan created by the User in the Service (plot, house, floors, utilities, objects, notes, version history) and its exports (PNG, PDF, JSON and other formats).
- User Content — Projects and everything the User uploads to or enters into the Service: underlays (scans, topographic surveys, photos, images), DXF/SVG/PDF/JSON/.plan files, 3D models, prompts to the AI assistant, notes, addresses, coordinates and cadastral numbers.
- Account — the user record created when signing in with a one-time email code.
- Anonymous access — use of the Service without an Account; ownership of a Project is determined by a technical identifier in a browser cookie.
- Reference Data — setback norms, protection zones, object dimensions, plant and material characteristics, prices, maps and cadastral information displayed by the Service.
3. Age and capacity
3.1. The Service is intended for persons aged 18 or older with full legal capacity. By using the Service you confirm that you meet this requirement. If the law of your country sets a different age for entering into such an agreement, that age applies.
3.2. If you use the Service on behalf of an organisation, you confirm that you are authorised to accept these Terms on its behalf.
4. Description of the Service and disclaimer of warranties
4.1. The Service is a tool for preliminary (sketch) planning. It helps place objects, estimate distances, areas and volumes, view a plan in 3D and prepare a diagram for discussion.
4.2. The Service is not a design, surveying, engineering, cadastral, valuation or legal service. Outputs of the Service (plans, diagrams, estimates, exports) are not design documentation, construction drawings, a boundary survey, a technical opinion or any other document of legal significance, and may not be relied upon for construction, permits, transactions or disputes without review by competent professionals and the documents and approvals required by law.
4.3. Reference Data (norms, protection zones, distances, dimensions, prices, plant and material characteristics) are compiled from public sources, may contain errors, become outdated, and may not reflect local zoning, regional or sector-specific rules or the specifics of a particular plot. The User must independently verify applicable rules against current primary sources and with competent authorities before making any decision.
4.4. Map, satellite and cadastral data are provided by third-party providers (including Esri, Google, Yandex and public state registries) and may be inaccurate in position, scale or currency. Locating a plot by address or cadastral number is approximate and does not replace a geodetic survey or official registry extracts.
4.5. Cost estimates, material quantities, drainage, irrigation, electrical, pool and other calculations are indicative, based on simplified models and typical assumptions. They do not replace a designer's calculation and are not a commercial offer.
4.6. The AI assistant uses large language models of third-party providers. Its answers and actions may be inaccurate, incomplete or wrong and may misinterpret norms and geometry. The User must verify the assistant's output. The assistant does not provide legal, engineering or other professional advice.
4.7. The Service provides tools for independent planning. We do not promise a particular construction, financial or aesthetic outcome, or the issuance of permits or approvals. The purchased access is defined by the plan description at payment. These qualifications do not remove our obligation to provide the paid features with the required quality.
4.8. We may update the interface, catalogs and Reference Data. Changes must not remove already purchased features or shorten a paid period, except where permitted by law. If a paid service cannot be provided, remediation or a refund is handled under section 10 and applicable law.
4.9. Before construction, installation or purchasing equipment, have appropriately qualified professionals verify measurements and site conditions, loads, ground conditions, structural design, fire and electrical safety, and gas, water and heating systems. The absence of warnings, a green indicator or a successful automated check only describes the built-in simplified model; it does not certify safety or compliance with all regulations. An AI image does not establish structural feasibility.
5. Account and anonymous access
5.1. Sign-in uses an email address and a one-time code. No password is used. You are responsible for access to your mailbox and for all actions taken in your Account.
5.2. With anonymous access, a Project is tied to a technical identifier in a browser cookie. Clearing cookies, changing browser or device, or using private browsing results in loss of access to anonymous Projects; it cannot be restored. Sign in by email to keep your Projects.
5.3. A Project link (project address, "share" link, public access) is a secret: anyone who has it can view or, in the relevant mode, edit the Project. You control distribution of links and bear the related risks.
5.4. We may delete Accounts and Projects inactive for more than 12 months, and anonymous Projects inactive for more than 6 months, notifying by email where an Account exists.
5.5. You may delete your Account in the settings; Projects and related data are then deleted as described in the Privacy Policy.
6. Rights to content
6.1. All rights to User Content remain with the User (or the respective rights holder). We claim no rights to your Projects.
6.2. To operate the Service you grant us a non-exclusive, royalty-free, worldwide licence to store, reproduce, process, convert, display and transmit User Content solely to the extent necessary to provide the Service (including autosave, versions, previews, export, display via share links, processing by the AI assistant and storage with our technical contractors).
6.3. By uploading content you warrant that you hold all necessary rights to it and that its use in the Service does not infringe third-party rights (copyright, related rights, image rights, personal data, trade secrets, etc.).
6.4. The exclusive rights to the Service, its code, design, databases, catalogs, icons, texts and the gardmi trademark remain with their respective rights holders. The User receives a limited, revocable, non-exclusive licence to use the Service for its intended purpose. Copying, decompiling, scraping and bulk extraction of catalogs and Reference Data, creating derivative services and circumventing technical limits are prohibited.
6.5. You may use plans exported from the Service (PNG, PDF, etc.) for any lawful purpose, including commercial, subject to clause 4.2.
7. Prohibited conduct
7.1. It is prohibited to:
- upload content that infringes third-party rights, contains malicious code, or contains third-party personal data without a lawful basis;
- use the Service to violate the law, prepare unlawful acts or interfere with others' property;
- disrupt the Service: automated requests, overloading, circumventing limits, guessing links to others' Projects, unauthorised access attempts;
- use the AI assistant to generate unlawful content or to extract system instructions;
- present Service outputs as official design or cadastral documentation.
7.2. We may, without notice, restrict access, remove content and block an Account in case of breach of these Terms or at the request of competent authorities.
8. User responsibility and indemnification
8.1. The User independently decides how to apply the Service results, including placement of objects, construction, planting, utility routing, purchases, transactions, filings with authorities and compliance with norms, rules and permitting procedures.
8.2. If the User breaches the law, third-party rights or these Terms, we may seek compensation for losses caused by that breach and legal costs under the procedures and limits established by law. Using the Service or making a good-faith claim does not itself make the User liable for our costs.
9. Limitation of liability
9.1. Claims for damages are assessed with regard to our contractual obligations, the circumstances of the breach, the amount of loss and its causal connection to the breach under applicable law. Construction, purchase or rework costs, neighbour disputes and lost profits are not automatically attributable to us merely because the User worked in gardmi. We do not assume the duties of a designer, contractor or permitting authority; mandatory liability for our own breaches remains.
9.2. Our liability is determined by applicable Russian law. These Terms do not limit mandatory consumer rights.
9.3. These Terms do not exclude liability for harm to life or health, intentional breach or other cases where limitation is prohibited by law. Providing the editor free of charge does not itself remove statutory liability. These Terms do not restrict the rights of third parties who are not parties to them.
10. Fees and paid services (gardmi Pro)
10.1. Self-directed design in the editor (plot, house, utilities, 2D and 3D, export and share links) is free. Paid gardmi Pro access (the "Subscription") provides expanded allowances for cloud Project and version storage, AI rendering and the AI assistant. Basic free storage and AI allowances remain available within the free plan. Payment covers these digital features and their usage, not the preparation of a construction or engineering design. Features, limits and prices on the gardmi Pro page form part of these Terms in the version available at purchase.
10.2. The provider of paid services is Individual entrepreneur Ivan Vyacheslavovich Vaskov, INN 661103103710. The same provider serves all language versions of the Service.
Payment for Pro and energy provides access to the described software features and their usage allowance. It is not an order for a bespoke engineering design, construction work, expert assessment or approval. AI images are illustrations and may differ from plan geometry and actual conditions. A result differing from subjective expectations alone does not establish a service defect; compliance with the advertised features and mandatory requirements is assessed separately.
10.3. Payment. Access to gardmi Pro is purchased for 30 days for RUB 590 through Robokassa. Card details are entered on the payment service page and are not sent to us. Access is granted automatically after Robokassa confirms payment. If confirmation is delayed, check the order status in your account or contact support.
10.4. One-time purchase. There is no auto-renewal or automatic charging. You place and pay for each subsequent purchase yourself at the price shown before payment.
10.5. Extension. If gardmi Pro is already active, the purchased 30 days are added to the current expiry date. Otherwise, the period starts when payment is confirmed.
10.6. Unsuccessful payment. An unpaid order does not grant access or reduce an existing paid period. Returning to our website from the payment page does not itself confirm payment.
10.7. End of the Subscription. When the Subscription ends, the User's Projects are neither deleted nor locked: they can still be opened, edited and exported. The limits of the free plan apply again (including creating new Projects and requests to the AI assistant); auto-versions of Projects above the free-plan number are deleted on the next saves of the Project, oldest first.
10.8. Cancellation and refunds. The User may cancel paid Pro access at any time by writing to support@gardmi.com. Include the Account email and order number if known. On cancellation, the unused period is refunded in proportion to the remaining part of the paid 30 days on the date the request is received, up to the amount of the corresponding payment. The refunded period is removed from paid access; other paid periods remain. The Account and Projects are not deleted. Refunds are made by the original payment method within 10 calendar days of receiving the request, unless the law requires a shorter period. Statutory consumer rights apply to defective or delayed services, including a different refund amount where required by law.
10.9. Allowances for AI features (messages on the smarter assistant model, etc.) are provided for personal use within the Service. Sharing Subscription access with third parties and automating requests is prohibited; in case of violation we may restrict AI features.
10.10. We may grant the Subscription free of charge (testing, promotions, compensation) for the term stated when granted; payment provisions do not apply to such a Subscription. Providing the core features free of charge creates no obligation to keep them free in the future; we announce changes to the free plan on the website in advance.
10.11. AI photos and all assistant messages use one energy balance: 1 unit per standard-model message and 10 per smarter-model message. There is no daily message quota; insufficient energy pauses generation until a top-up or refill. Energy is returned if generation fails technically. Energy packs for AI features are purchased separately: 100 units for RUB 149 or 300 units for RUB 390. Energy is credited automatically after payment confirmation, does not expire and is used after the weekly allowance. These are internal units for using Service features, not money or a means of paying third parties.
10.12. Energy refunds. To cancel the unused part of a paid pack, write to support@gardmi.com with the Account email, order number (if known) and number of units to refund. The refund equals the number of unused paid units eligible for refund multiplied by the unit price of the corresponding pack at purchase (the amount actually paid divided by the pack size). The remaining balance is checked against purchase and usage history; the refund cannot exceed the corresponding payment. Refunded units are deducted from the additional balance; other paid units remain. Weekly allowances and free energy have no cash refund value. A response and refund by the original payment method are provided within 10 calendar days of receiving the request, unless the law requires a shorter period. Mandatory consumer rights for defective services and other statutory cases take precedence over this calculation.
11. Third-party services
11.1. The Service uses third-party maps, cadastral data, AI models, cloud storage, analytics, monitoring and email delivery. Independent external resources may change their data or availability. Using suppliers to provide paid services does not release us from our obligations to the User; a supplier outage alone does not constitute force majeure.
12. Rights-holder notices
12.1. If you believe content in the Service infringes your rights, send a notice to support@gardmi.com describing the protected work, a link to the disputed content, your contact details and proof of authority. We will review the notice and, if the infringement is confirmed, restrict access to the content.
13. Changes to the Terms
13.1. Updated Terms are published on this page with their effective date. Material changes are announced on the website or by email in advance. They apply to subsequent purchases and use to the extent permitted by law; they do not worsen the terms of already paid periods or packs, remove accrued claims or constitute consent to new personal-data processing purposes.
14. Governing law and disputes
14.1. These Terms are governed by the laws of the Russian Federation, unless mandatory consumer-protection rules of the User's country require otherwise.
14.2. For prompt review, send your claim to support@gardmi.com. Include the purchase details known to you (Account email, order number or payment date and amount), the issue and your requested remedy. For a technical error, its time, reproduction steps and a screenshot are helpful; for a damages claim, include your calculation and available supporting materials. Do not send passwords, sign-in codes or full card details. Missing optional materials alone is not a reason to refuse a claim. We respond within 30 calendar days, or within the period in section 10 for refunds; shorter mandatory deadlines take precedence.
14.3. We may request proportionate information needed to locate the order, investigate the error and confirm that the Account or payment belongs to the claimant. Notarisation or routine submission of a passport is not required. Requests for clarification do not themselves suspend statutory deadlines. Written claims are also accepted at the registered address. Contacting support is not a prerequisite for going to court unless expressly required by law; statutory remedies and venue choices remain available.
15. Users in the EEA, UK and USA
15.1. For users in the European Economic Area and the United Kingdom nothing in these Terms limits rights granted by mandatory consumer-protection and data-protection rules (GDPR / UK GDPR). For California users, applicable CCPA provisions are described in the Privacy Policy.
16. Miscellaneous
16.1. Invalidity of any provision does not invalidate the Terms as a whole. 16.2. These Terms together with the Privacy Policy constitute the entire agreement of the parties. 16.3. We may assign our rights and obligations to an affiliate or successor with notice on the website. 16.4. Neither party is liable for non-performance caused by force majeure.
