Tree and shrub distance from the fence

Italy

Unless local regulations or established local customs provide otherwise, Article 892 requires 3 m for tall trees, 1.5 m for non-tall trees and 0.5 m for vines, shrubs, live hedges and fruit trees no taller than 2.5 m. A dividing wall without openings can trigger the statutory exception.

Distances and rules

Tall trees are planted farthest from the boundary, shrubs closest, so crown and roots do not shade or damage the neighbour’s plot or utilities.

Tall tree 3 m from the boundary Italy — Civil Code, Articles 873–899
Non-tall tree 1.5 m from the boundary Italy — Civil Code, Articles 873–899
Shrub / live hedge / small fruit tree 0.5 m from the boundary Italy — Civil Code, Articles 873–899

Important limitation

This is a planning aid, not a legal opinion. Before construction, check the local land-use rules, easements, the network/utility operator’s requirements and neighbour buildings.
